Terms of Service

These Terms of Service ("Terms") govern your use of the Host Ghost website, mobile application, and game server hosting services (collectively, the "Service") operated by Host Ghost ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you must have the consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.
2. Account Registration
To use the Service, you must create an account with a valid email address and password. You are responsible for:
- Maintaining the security and confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized access to your account
We reserve the right to suspend or terminate accounts that violate these Terms.
3. Service Description
Host Ghost provides game server hosting services. When you subscribe to a plan, we provision and manage dedicated game server instances on your behalf. The Service includes:
- Automated game server deployment and management
- Web-based and mobile server controls (start, stop, restart)
- Console access for server administration
- Custom subdomain assignment
- Real-time server monitoring and notifications
4. Subscription and Billing
Plans: We offer multiple subscription tiers with varying resource allocations. Plan details and pricing are displayed on our website and may be updated from time to time.
Billing Cycle: Subscriptions are billed monthly. Each game server requires its own subscription.
Payment: All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.
Cancellation: You may cancel your subscription at any time. Upon cancellation, your server remains active until the end of the current billing period. After that, the server will be suspended.
Refunds: We offer refunds on a case-by-case basis within 48 hours of initial purchase. Contact [email protected] for refund requests.
Past Due Accounts: If a payment fails, you will have a 3-day grace period to update your payment method. After the grace period, your server will be suspended. Servers remain recoverable for 30 days after suspension, after which data may be permanently deleted.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Host or distribute malware, viruses, or malicious software
- Conduct denial-of-service attacks or network abuse
- Store or distribute illegal content
- Infringe on the intellectual property rights of others
- Attempt to gain unauthorized access to our systems or other users' servers
- Use servers for purposes other than game hosting (e.g., cryptocurrency mining, proxying)
- Resell or redistribute server resources without our written consent
- Harass, threaten, or abuse other users
We reserve the right to suspend or terminate your service immediately if we determine you are violating these acceptable use policies.
6. Resource Limits
Each subscription plan includes defined resource limits (RAM, CPU, storage, player slots). If your server consistently exceeds its allocated resources, we may ask you to upgrade to a higher tier. Excessive resource usage that impacts other users may result in temporary throttling.
7. Service Availability
We strive to maintain 99.9% uptime for our services. However, we do not guarantee uninterrupted access. Planned maintenance windows will be communicated in advance when possible. We are not liable for downtime caused by:
- Force majeure events (natural disasters, power outages, etc.)
- Third-party service failures (ISP outages, upstream providers)
- Game software bugs or updates
- DDoS attacks or security incidents
- Scheduled maintenance
8. Data and Backups
We perform regular backups of game server data. However, you are ultimately responsible for maintaining your own backups of critical data. We are not liable for data loss resulting from hardware failures, software errors, or account termination.
9. Intellectual Property
The Service, including its design, branding, and underlying technology, is the property of Host Ghost. You retain ownership of any content you create on your game servers (worlds, configurations, etc.).
Game titles, logos, and software hosted through our Service are the property of their respective developers and publishers. Host Ghost is not affiliated with or endorsed by any game publisher unless explicitly stated.
10. Limitation of Liability
To the maximum extent permitted by law, Host Ghost shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising from your use of the Service.
Our total liability for any claims arising from or relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Host Ghost, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.
12. Modifications to Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Service.
13. Termination
We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination:
- Your right to use the Service ceases immediately
- We may delete your server data after 30 days
- Sections that by their nature should survive termination will survive (including Limitation of Liability, Indemnification, and Governing Law)
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
